The company reserves the right to add, delete or modify any provision of these terms and conditions at any time and without prior notice. Failure to receive notice of a change to these terms and conditions does not invalidate that change. Payment for services to the company: All prices provided by the company are without VAT unless otherwise specified. The price of the services provided by the company is defined in the quote that the client receives by email. The quotes issued by the company are valid for a period of 30 days unless the company indicates otherwise.

 

After this period the company reserves the right to alter the budget for the same services. The company reserves the right to alter the budget if the client proposes any type of change or for reasons it deems appropriate, and in any case, a budget has no contractual value until the company and the client formalize the start of the project by means of payment of the first invoice. Unless otherwise agreed with the client, the company will charge 40% of the total price of the project ordered by the client in advance. The client will pay the remaining 60% at the end of the project, upon delivery by the company of the files for the migration.

 

The company will not start any project until the client has paid the initial 40% nor will it deliver the files for any project until the final 60% payment has been received. In the case of periodic services, such as SEM campaigns or SEO maintenance, the company will charge the first month in advance and subsequently at the end of each month, unless the company and the client agree otherwise. Payment for the services will be made by bank transfer, proof of which the client will send to the company by email. In the case of ads in SEM campaigns, the client will provide the company with their credit card number so that Google, Facebook or the supplier companies can directly charge the cost of the ads to their account. Delivery Time: The company will agree with the client on delivery times before accepting the quote, and undertakes to respect them to the maximum.

 

For its part, the client agrees to provide the contents of the website (texts, images, videos, graphics, sound files) at the time of making the initial bank transfer with 40% of the total price of the project in advance. Requirements to Install the website: If the client requires that his website be installed on a server of his choice, he agrees to provide the company with temporary access to his hosting via FTP. Depending on the specific nature of the project, the company may also need client access to other server resources. The development of the project until it is finished will be done on a test server owned by the company. The client will have access to their website on the test server to review the changes to their project.

Once the website has been migrated, the maintenance of the hosting will be the responsibility of the client, unless they contract web maintenance with the company (see section "Maintenance of the website once delivered"). Copyright of the Contents: If the company is not contracted to produce content, the client agrees to provide unpublished content that is their property. The company reserves the right to ask the client for documentary justification of the authorship of texts, photos and videos, and in no case will it use material that is not the property of the client in the development of the web project. In any case, the client will be liable for the copyright of the material used on its website in the event of possible requests from the relevant authorities and will hold the company harmless from possible claims from third parties due to negligence or inability to obtain the copyright of the content.

 

Compliance with the LOPD: The client is responsible for ensuring that their website complies with the Organic Law on Data Protection. The company, upon request, within the price of all projects, will include a legal notice page and a privacy policy page accessible from the bottom of the website, the texts of which must be provided by the client, who will be responsible for its adaptation to the current legislation. Review of changes: Unless the company and client agree otherwise, the client will have the right to two reviews of changes in their web project. These revisions will involve small modifications (fonts, photographs, inclusion or exclusion of elements, etc.), not substantial design revisions (changes in the structure of the website, layout of the sections, additional programming of web functionalities, etc.) or revisions substantial content (texts, images, etc.).

Excessive feedback from the Client: The client accepts that the company has various projects underway and therefore cannot provide ongoing feedback, beyond the specific needs that may arise during the project. On the other hand, the client accepts that, to be competitive in prices and quality, the company cannot meet in person unless the budget includes meetings or agrees otherwise with the client.

 

The company prioritizes emails as a means of communication with the client. If the client requires an additional meeting halfway through the project, the company reserves the right to extend the budget to include the time spent in the meeting or change it to a Skype call or similar, which would also be included in the final budget. if it is not possible for you to attend due to scheduling issues. Cancellation of a Project: The client has the right to cancel a project, as long as it is done in writing. Operation of the websites on different devices and browsers: The company undertakes to adapt the web projects to the main devices and most used browsers (Firefox, Internet Explorer in its latest versions, Google Chrome, etc.), but cannot guarantee the operation of all web functionalities with browsers that have certain extensions and that work with certain types of operating systems. The client accepts this condition, as well as the fact that the company is not responsible for the subsequent adaptation of the page to new versions of browsers and devices, reserving the right to budget for it separately. The client also accepts that the company does not physically have all the devices on the market to directly test its websites and that it uses simulators, which in very rare cases may not match 100% with the display of the device in question.

 

Website or online store management: The company provides websites and online stores that are easy to self-manage. However, the client accepts that they must have basic knowledge of WordPress (text management, adding or deleting pages and menus, etc.) or WooCommerce (text management, prices, coupons and promotions; adding or deleting products, etc. .) In case the client needs screenshots or tutorials of any type, written or video, the company will quote it separately. The client accepts that the self-manageable concepts do not include those that may cause an imbalance in the design, such as sizes, colors and font types, size of the images, footer, proportions of the sections, etc.

 

The company will not be responsible for any imbalance in the design due to modifications made from the code or those made through self-managed modules that do not respect the initial configuration, for example, changes of photos for others with different measurements or proportions, of larger texts. longer or shorter than those present in the initial version, among others. On the other hand, the client accepts that the projects do not include specific plugins for web analytics, data or stock management, billing, taxation or others that do not come by default with WordPress or WooCommerce unless otherwise agreed with the company. Maintenance of the website or system once delivered: The company delivers to the client a website in perfect working order, which the client must check at the time of delivery. Needs of any kind that arise for the client regarding their website after delivery will be budgeted separately and will be carried out in accordance with the company's availability, including those that are urgent (web server down, slow loading, viruses in databases or others) and those that are periodic (adaptations of the website to new versions of browsers or devices, updates of plugins and software, etc.)

 

This concept also includes updating the website's content manager (WordPress or similar), the plugins used or solving errors that the client has made when modifying their website or in any other way, contact with the hosting provider. of the client in case of a problem or any need that arises after delivery, testing of payments or sending of forms or any concept derived from the operation and maintenance of the website, including advice. In the event that the client contracts web maintenance services with the company, he has the right to have the company solve the aforementioned needs in accordance with the conditions of the type of service that he has contracted, excluding substantial modifications to the website, which do not are included in any type of web maintenance (see specific conditions of each service).

 

The company reserves the right to budget separately for modifications resulting from code manipulation by the client or the incompatibility of a new version of WordPress or any other CMS with initially custom-programmed functionalities, as they are beyond the control of the company. company, even if you have contracted the web maintenance service. Maintenance of the domain and hosting: The company will place the domains that the client needs to purchase in the name of the client, who will be responsible for paying their annual fee by credit card or the payment method they wish. If the client contracts web maintenance services from the company, which are associated with the hosting offered by the company, they will not have to assume additional costs because the price of the hosting is included in the web maintenance fee. If you want to cancel the web maintenance service with the company, the client must first migrate their website to another hosting of their choice. They will not be able to keep the one provided by the company, given that the two services are contractually linked. If you need the migration to the new hosting to be done by the company, it will budget for said migration separately. Development or website credits: The client's website will not contain any reference to the company, however, the client accepts that the company includes its website in its portfolio.
